Ambito di applicazione

La presente Informativa Privacy trova applicazione nel momento in cui l’Interessato visita o utilizza il sito web raggiungibile all’indirizzo https://www.plumai.it/ .

Pluma S.r.l (di seguito, "Pluma"), in qualità di titolare del trattamento dei dati (in seguito “Titolare”), La informa, ai sensi dell’art. 13 Regolamento UE 679/2016 (in seguito “GDPR”), che i dati da Lei forniti sono trattati con le modalità e per le finalità di seguito descritte:

I Dati Personali oggetto del trattamento appartengono alle seguenti categorie:

  • dati di navigazione acquisiti nel momento in cui si visita o utilizza il sito web raggiungibile all’indirizzo https://www.plumai.it/; in questa categoria di dati rientrano gli indirizzi IP o i nomi a dominio dei computer utilizzati da coloro che si connettono al sito, gli indirizzi delle risorse richieste in notazione Uri (Uniform resource identifier), l’orario della richiesta, il metodo usato nel sottoporre la richiesta al computer server, la dimensione del file ottenuto in risposta, il codice numerico indicante lo stato della risposta ottenuta (errore, buon fine, ecc.) e altri parametri relativi al sistema operativo e all’ambiente informatico dell’utente;
  • dati comuni e di contatto forniti dall’Interessato compilando ed inoltrando gli appositi Form disponibili sul sito per richiedere informazioni sui servizi offerti dal Titolare o per valutare, nell’interesse dell’utente, l’idoneità dei suoi processi documentali rispetto ai servizi offerti da Pluma e fornirgli indicazioni preliminari sul possibile ambito di applicazione: nome e cognome, indirizzo e-mail, azienda di appartenenza e ruolo di riferimento;
  • ove vi fosse, nelle more dell'esecuzione delle attività da Lei richieste, la necessità di trattare dati ulteriori, non rientranti nella categoria sopracitata, sarà avvisato tempestivamente dal Titolare.

Cookie e tracciamento del sito

Questo sito web non utilizza alcun tipo di cookie, né tecnici né di profilazione o tracciamento, né di prima parte né di terze parti. Non viene svolta alcuna attività di tracciamento degli utenti o di memorizzazione di dati di navigazione sui dispositivi dei visitatori.

Finalità e Base giuridica del trattamento

I Suoi dati personali sono trattati, per le seguenti finalità:

  • in relazione ai dati di navigazione, il Titolare effettuerà il trattamento con la finalità di migliorare l’esperienza di navigazione dell’interessato sul sito web. La base giuridica per tale tipologia di trattamento è il legittimo interesse del Titolare, ex art. 6.1 lett. f) GDPR;
  • in relazione ai dati forniti dall’Interessato nel corso della compilazione dei Form disponibili sul sito per richiedere informazioni sui servizi offerti dal Titolare e per valutare, nell’interesse dell’utente, l’idoneità dei suoi processi documentali rispetto ai servizi offerti da Pluma e fornirgli indicazioni preliminari sul possibile ambito di applicazione, la finalità è l’evasione delle richieste dello stesso Interessato. La base giuridica per il trattamento di tali dati è l’esecuzione di misure precontrattuali adottate su richiesta dell’Interessato, ex art. 6.1 lett. b) GDPR.

Modalità del trattamento e Conservazione

Il trattamento sarà effettuato mediante sistemi informatici (cloud, internet, computer e dispositivi mobili) e, residualmente in modalità cartacea, con le modalità adeguate a garantirne la riservatezza e la sicurezza.

I dati saranno conservati nelle banche dati del Titolare per il solo tempo strettamente necessario, in conformità alla legge e secondo quanto sopra precisato, e, in ogni caso:

  • in relazione ai dati di navigazione, per un periodo massimo di 7 giorni dalla raccolta;
  • in relazione agli altri dati inseriti dall’Interessato sui form disponibili sul sito per il tempo strettamente necessario all’evasione della richiesta dell’interessato, in ogni caso, non superiore a 6 mesi.

Natura del conferimento dei Dati e conseguenze del rifiuto

La natura del conferimento dei dati muta in base alla finalità del trattamento:

  • in relazione ai dati di navigazione il conferimento è obbligatorio e implicito nei protocolli di comunicazione della rete Internet; il mancato conferimento comporta l'impossibilità di navigare sul sito;
  • in relazione dei dati inseriti nei form, il conferimento è facoltativo, ma necessario per permettere al Titolare di ricontattare l'utente; il mancato conferimento comporta l'impossibilità di evadere la richiesta dell’Interessato.

Accesso ai Dati

I Suoi Dati saranno trattati per le finalità e con le modalità di cui sopra da personale e/o collaboratori del Titolare specificatamente autorizzati del trattamento e sulla base delle istruzioni ricevute, nonché da soggetti terzi (ad esempio, fornitori, professionisti, affiliati, partener commerciali) ove svolgano attività in outsourcing per conto del Titolare, nella loro qualità di responsabili esterni del trattamento o titolari.

Comunicazione dei Dati

Il Titolare potrà comunicare i Suoi dati ad Enti pubblici per ottemperare agli obblighi previsti da leggi, regolamenti o dalla normativa comunitaria e nazionale, ovvero imposti dalle Autorità, che li tratteranno nella loro qualità di titolari autonomi del trattamento.

Potranno essere comunicati a Soggetti Terzi (ad esempio, fornitori, professionisti, partner) ove svolgano attività strumentali o accessorie ai servizi richiesti e alle finalità di cui sopra, per conto del Titolare nella loro qualità di responsabili esterni del trattamento o titolari.

L’elenco aggiornato di tali soggetti può essere richiesto al Titolare del trattamento, agli indirizzi sopra indicati.

In genere i fornitori di servizi prescelti operano tramite data center localizzati sul territorio dell’Unione Europea.

Nel caso i Suoi dati fossero oggetto di trasferimento al di fuori dello Spazio Economico Europeo (SEE), per finalità di gestione tecnica o statistica dei dati raccolti, questo avverrà esclusivamente nel pieno rispetto del Regolamento UE 2016/679, verso Paesi terzi, per i quali la Commissione europea abbia riconosciuto specifiche garanzie di adeguatezza o siano state fornite adeguate garanzie di tutela dei dati personali, per mezzo della sottoscrizione delle Clausole Contrattuali Standard approvate dalla Commissione Europea in base alla Decisione 2021/914/UE per il trasferimento di dati personali tra Paesi UE verso PAESI non UE, indicando le ulteriori misure di sicurezza adottate, per la tutela della riservatezza dell’interessato.

I dati potranno, dunque, essere comunicati a:

  • collaboratori e dipendenti di Pluma S.r.l. appositamente autorizzati;
  • fornitori di servizi IT, hosting cloud e manutenzione software nominati Responsabili Esterni del Trattamento ex art. 28 GDPR;
  • consulenti legali e fiscali del Titolare per finalità di tutela dei diritti e gestione amministrativa;
  • autorità pubbliche o giudiziarie nei casi previsti dagli obblighi di legge.

Diritti dell’interessato

In ogni momento potrà esercitare i Suoi diritti nei confronti del titolare del trattamento, ai sensi dell'artt.15-22 del Regolamento UE 2016/679, ed in particolare i diritti di accesso, rettifica, integrazione e, nei casi consentiti la portabilità dei dati conferiti, oltre ad ottenere la cancellazione, la limitazione o l’opposizione al trattamento dei Dati per motivi legittimi e di opporsi al processo decisionale automatizzato, inclusa la profilazione, nonché il diritto di reclamo all’Autorità Garante.

Diritto di accesso

L’interessato ha il diritto di ottenere dal titolare del trattamento la conferma che sia o meno in corso un trattamento di dati personali che lo riguardano e in tal caso, di ottenere l’accesso ai dati personali e alle informazioni riguardanti il trattamento.

Diritto di rettifica

L'interessato ha il diritto di ottenere dal titolare del trattamento la rettifica dei dati personali inesatti che lo riguardano senza ingiustificato ritardo. Tenuto conto delle finalità del trattamento, l'interessato ha il diritto di ottenere l'integrazione dei dati personali incompleti, anche fornendo una dichiarazione integrativa.

Diritto alla cancellazione (Diritto all’oblio)

L'interessato ha il diritto di ottenere dal titolare del trattamento la cancellazione dei dati personali che lo riguardano senza ingiustificato ritardo e il titolare del trattamento ha l'obbligo di cancellare senza ingiustificato ritardo i dati personali.

Diritto di limitazione al trattamento

L'interessato ha il diritto di ottenere dal titolare del trattamento la limitazione del trattamento quando ricorre una delle seguenti ipotesi:

  • a) l'interessato contesta l'esattezza dei dati personali, per il periodo necessario al titolare del trattamento per verificare l'esattezza di tali dati personali;
  • b) il trattamento è illecito e l'interessato si oppone alla cancellazione dei dati personali e chiede invece che ne sia limitato l'utilizzo;
  • c) benché il titolare del trattamento non ne abbia più bisogno ai fini del trattamento, i dati personali sono necessari all'interessato per l'accertamento, l'esercizio o la difesa di un diritto in sede giudiziaria;
  • d) l'interessato si è opposto al trattamento ai sensi dell'articolo 21, paragrafo 1, in attesa della verifica in merito all'eventuale prevalenza dei motivi legittimi del titolare del trattamento rispetto a quelli dell'interessato.

Diritto alla portabilità dei dati

L'interessato ha il diritto di ricevere in un formato strutturato, di uso comune e leggibile da dispositivo automatico i dati personali che lo riguardano forniti a un titolare del trattamento e ha il diritto di trasmettere tali dati a un altro titolare del trattamento senza impedimenti da parte del titolare del trattamento cui li ha forniti.

Nell'esercitare i propri diritti relativamente alla portabilità dei dati a norma del paragrafo 1, l'interessato ha il diritto di ottenere la trasmissione diretta dei dati personali da un titolare del trattamento all'altro, se tecnicamente fattibile.

Diritto di opposizione

L'interessato ha il diritto di opporsi in qualsiasi momento, per motivi connessi alla sua situazione particolare, al trattamento dei dati personali che lo riguardano ai sensi dell'articolo 6, paragrafo 1, lettere e) o f), compresa la profilazione sulla base di tali disposizioni.

Diritto di non essere sottoposto a processo decisionale automatizzato, compresa la profilazione

L'interessato ha il diritto di non essere sottoposto a una decisione basata unicamente sul trattamento automatizzato, compresa la profilazione, che produca effetti giuridici che lo riguardano o che incida in modo analogo significativamente sulla sua persona.

Esercizio dei diritti

I suddetti diritti possono essere esercitati inviando una e-mail al Titolare all’indirizzo m.marvulli@plumai.it.

Al fine di garantire la protezione delle informazioni personali dell’interessato, potremmo aver bisogno di richiedere ulteriori informazioni specifiche, che confermino l'identità dell’interessato richiedente e garantirne così il diritto di accesso alle informazioni (o a esercitare uno qualsiasi degli altri diritti) solamente a persone aventi il diritto di ricevere tali comunicazioni. Si tratta di un'altra misura di sicurezza idonea alla protezione dei dati personali.

La richiesta di accesso alle proprie informazioni personali (o per esercitare uno dei diritti sopraindicati) è gratuita. The legal basis is taking steps at the data subject’s request before entering into a contract under Article 6(1)(b) GDPR.

Data may be disclosed to third parties, such as suppliers, professionals and partners, where they provide supporting or ancillary activities for the requested services and purposes described above, on behalf of the Controller as external processors or independent controllers.

The selected service providers generally operate through data centres located within the European Union.

If your data is transferred outside the European Economic Area (EEA) for technical management or statistical purposes, this will take place only in full compliance with Regulation (EU) 2016/679. Transfers will be made to third countries for which the European Commission has recognised an adequate level of protection or where appropriate safeguards have been provided through the Standard Contractual Clauses approved by the European Commission under Decision 2021/914/EU for transfers of personal data from EU countries to non-EU countries, together with any additional security measures adopted to protect the data subject’s confidentiality.

Data may therefore be disclosed to:

  • duly authorised employees and collaborators of Pluma S.r.l.;
  • IT, cloud hosting and software maintenance providers appointed as external processors under Article 28 GDPR;

Rights of the data subject

You may exercise your rights against the Controller at any time under Articles 15–22 of Regulation (EU) 2016/679. These include the rights of access, rectification and completion and, where applicable, data portability; the rights to obtain erasure or restriction of processing or to object to processing on legitimate grounds; the right to object to automated decision-making, including profiling; and the right to lodge a complaint with the supervisory authority.

Right of access

You have the right to obtain confirmation from the Controller as to whether personal data concerning you is being processed and, where that is the case, to access the personal data and information about the processing.

Right to rectification

You have the right to obtain rectification of inaccurate personal data concerning you without undue delay. Taking account of the purposes of the processing, you have the right to have incomplete personal data completed, including by providing a supplementary statement.

Right to erasure (right to be forgotten)

You have the right to obtain erasure of personal data concerning you without undue delay, and the Controller has an obligation to erase personal data without undue delay.

Right to restriction of processing

You have the right to obtain restriction of processing where one of the following applies:

  • a) you contest the accuracy of the personal data, for the period required by the Controller to verify its accuracy;
  • b) the processing is unlawful and you oppose erasure of the personal data and request restriction of its use instead;
  • c) the Controller no longer needs the personal data for processing purposes, but you require it to establish, exercise or defend legal claims;
  • d) you have objected to processing under Article 21(1), pending verification of whether the Controller’s legitimate grounds override yours.

Right to data portability

You have the right to receive personal data concerning you that you provided to a controller in a structured, commonly used and machine-readable format, and to transmit that data to another controller without hindrance from the controller to which it was provided.

When exercising the right to data portability under paragraph 1, you have the right to have the personal data transmitted directly from one controller to another where technically feasible.

Right to object

You have the right to object at any time, on grounds relating to your particular situation, to processing of personal data concerning you under Article 6(1)(e) or (f), including profiling based on those provisions.

Right not to be subject to automated decision-making, including profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects concerning you or similarly significantly affects you.

To protect your personal information, we may need to request specific additional information to confirm your identity and ensure that only people entitled to receive the information can exercise the right of access or any other right. Requests to access your personal information or exercise any of the rights above are free of charge. However, if a request is clearly unfounded or excessive, we may charge a reasonable fee reflecting the administrative costs of providing the information or refuse to act on the request.

Rights of the data subject

You may exercise your rights against the Controller at any time under Articles 15–22 of Regulation (EU) 2016/679. Right to data portability

Right not to be subject to automated decision-making, including profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects concerning you or similarly significantly affects you.
